The Website and/or Company shall not be liable for any such action. If a refund is requested and the order has already been paid for, the refund will be processed directly back to Your credit card, debit card, bank account or any other payment method used for such transaction.

The Company shall not be liable for any injury suffered by or inflicted on You while unpacking or opening the contents of the packaging or the product or at the time of handling or using the product purchased by You from the Website. In the event You notice that the product is missing, damaged or defective in any way (not on account of Your fault or actions), You are requested to notify the Company within 48 hours of receiving the package. You shall not hold the Company responsible or claim any losses for any injury to You or any other person, arising from handling or using such damaged or defective product.

If there is any delay or failure to comply with Our obligations under these terms & conditions on account of any unforeseeable event which is beyond Our control, We shall not be liable for any losses arising, if any, from such delay or failure to comply to with terms & conditions.

Notwithstanding anything to the contrary, the entire liability of the Company to You, in any event, shall be the refund of the money that is charged to You, if the Company is under any liability to pay any amount. In no event shall the Company and/or any of its directors, officers, employees, suppliers or vendors be liable to You or any third party for any type of special, incidental, indirect, consequential or punitive damages whatsoever. This includes any theory of liability, including warranty or breach of contract, negligence or other tortious action, or any other claim arising out of or in connection with Your purchase of any products and services from the Website.

Waiver

In case We take no action for Your breach of these terms and conditions, the same shall not constitute a waiver of Our rights. We will still be entitled to use Our rights and remedies for any subsequent breach of these terms and conditions.

Governing Law, Jurisdiction and Disputes

Access or use of the Website or orders placed by You on the Website or matters relating thereto, shall be governed in accordance with laws of India, regardless of the laws that might be applicable under principles of conflicts of law. Any claims, transactions and disputes related to the Terms & Conditions of the Website and/or the relationship between You and the Company or the purchases made by You on the Website shall be subject to exclusive jurisdiction of the courts at Mumbai, India and You hereby accede to and accept the jurisdiction of such courts.

CANCELLATION & RETURN/EXCHANGE POLICY

After having placed their order, customers may cancel their order only if the order has not been dispatched yet. We do not accept any cancellation on orders after the product has been dispatched from our warehouse.

In case of cancellation, there is no credit refund given on the purchase amount, but you may exchange it for another product(s) of same or higher value by paying the remainder. You may also opt for credit note that can be redeemed later for any future purchase on our website with validity of 2 months.

Note: Any delay in delivery due to unexpected circumstances in transit, order cannot be cancelled. In case of cancellation no credit refund will be provided.

We acknowledges return of products only limited to direct sale between vendor and consumer. This only entails sale online, and not through retail outlets.

Any product that has been hampered or damaged while transportation MUST be notified by email within 48 hours of the product being delivered and returned to our warehouse within a strict time period of one week, else we will not be liable to accept the merchandise. In such cases, the customer will have to write in to hey@elanaccessories.in and a prompt response is guaranteed from our end. We will investigate the damage from our end and repair the merchandise in entirety.

ALL couriers of this nature will be borne by the customer themselves. We will only bear the expenses of the transaction after the repair of the merchandise.

In cases wherein due to usage of the merchandise, some part of the product is damaged, such as hardware – locks, studs, screws , buckles, straps, will only be repaired within a period of two weeks from the time of receipt of the merchandise after dispatch from our warehouse.

Please note, damaged products specific to repair will have to be couriered back to our warehouse wherein all costs will be borne by the customer themselves. We will only bear the expenses of the transaction after the repair of the merchandise.

Personalised/Customized products are not subject to return or exchange.

In case of return, there is no credit refund given on the purchase amount, but you may exchange it for another product(s) of same or higher value by paying the remainder within the exchange period of 1 month. You may also opt for credit note that can be redeemed later for any future purchase on our website with validity of 2 months.

Please note that the assistance provided in terms of exchange, return or repair of damaged products shall remain specific to the country where the product was purchased.

SHIPPING & DELIVERY POLICY

For the time being, We only process orders for delivery within India.

Your shipping address, city, state and pin code will be verified before shipping the product. If Your order cannot be delivered by Our delivery partners, We shall request You to provide Us with a different shipping address that can be serviced by Our delivery partners. If there is any dispute regarding the delivery of any order to the shipping address specified by You that is not covered by Our delivery partners, the Company shall not be held responsible for not delivering the products. If the order has already been paid for, the refund will be processed directly back to Your credit card, debit card or bank account or any other payment method used for the transaction.

Depending on the value of the order placed by You, the product(s) may have to be shipped in different batches or consignments, for which an intimation shall be sent to You.

Before processing, dispatching or delivering any product or service to You, the Company may request You to provide documents supporting Your identity. These documents may include, but are not limited to, an identification or residence proof issued by the Government of India, to establish the ownership of the instrument of payment used by You for the purchase of a product or service.

We usually get most orders delivered within 6 to 15 working days from the date of Order Acceptance. Based on Your location, an estimate of delivery period is provided when completing the checkout process. The estimated days mentioned regarding dispatch and delivery times are for guidance only. The Website or the Company shall not be held liable to meet such estimated dispatch and delivery guidelines. In case of any delays in delivery of a product that occur because of reasons beyond Our control, We shall not be held responsible for the same.

COLOR VARIATIONS / WEAR & TEAR

Leather : Reproduction of colors is as accurate as possible, although please note, colors available at the stores may vary slightly from what is displayed on your monitor. Also, leather is a natural material and a slight variation is bound to appear in each item.

Fabric : Some products have digital printing on fabric on which slight variation might occur in different parts or patches. This is a general property of the fabric which cannot be controlled.

Hardware Color : Some of the products with metal hardware might tarnish or lose its shine over time due to weather conditions and usage. These are changes which occur due to the varied use and handling of the product by the customer and cannot be held against the manufacturers.

Defects and Scratches : All our products are hand crafted , hence no two products are identical in their absolute measurements. There might be a slight change, but minimal to the eye which therefore would not change the essence of the design.

Scratches and Marks: Scratches and marks on the leather surface are a part of the characteristics of the material. They do not qualify as defects. This can happen due to use over a period of time which enhances the look and feel of the product, adding to its vintage appeal. Some types of leather might have a slight patina on the surface due to usage and is the quality of the leather. Products are only designed seeing and keeping in mind all the above mentioned factors. Marks are common on leather as each skin is different to the other, as no two skins are the same. Please note, these are NOT considered as defects or rejects. This can happen due to use over a period of time which enhances the look and feel of the product, adding to its vintage appeal. WARRANTY POLICY

Certain products sold on this Website are covered by ‘Limited Warranty’ as specified in the product description of such product. We provide Limited Warranty for such product(s) against manufacturing defects in material and workmanship under ordinary consumer use. This Limited Warranty does not extend to defects, damage or breakage or loss caused due to accident, misuse, regular wear and tear, neglect, fire or damage from other external causes, alteration, repair, or commercial use, not attributable to the manufacturer’s material or workmanship of the product.

The warranty period relating to a product is subject to the period mentioned in the product description of that product (hereinafter referred to as “Limited Warranty Period”).

During the Limited Warranty Period, if a defect arises in a product, You are required to follow Our instructions for returning the product. You are required to ensure that the product is well-packed, using either the original packaging or packaging material of equal grade, so that no damage is caused to the product in transit. We will, at Our option, to the extent permitted by law, either (i) repair the product using either new or refurbished parts, (ii) replace the product with a new or refurbished product that is equivalent to the product to be replaced, or (iii) refund to You the purchase price of the product.

The Limited Warranty applies, to the extent permitted by law, to any repair or replacement made by the Company till the remainder of the original Limited Warranty Period. All replaced products and products for which a refund is given shall become Our property.

Limitation of Liability

The Company disclaims all other warranties, express or implied, including, but not limited to the implied warranties of merchantability or fitness for a particular purpose. Any implied warranties that may be imposed by applicable law are limited to the duration of the Limited Warranty Period. In no event shall the Company be liable for any incidental, special or consequential damages, consequential human injury or loss, including, but not limited to loss of business, etc. whether in an action in contract or tort or based on a warranty arising out of or in connection with the use or performance of the product, even if We have been advised of the possibility of such damages.

You agree that repair or replacement, as applicable, under the Limited Warranty described herein are the sole and exclusive remedies with respect to any breach of the Limited Warranty set forth herein.

If any provisions of the Limited Warranty are judged to be unenforceable or illegal, the continuation of the other provisions will not be affected.

The Limited Warranty is not transferable from one user/customer to another. Only if a customer transfers the ownership of a product to another end user, the remainder of the Limited Warranty Period may also transfer to the new owner.

Our maximum liability under the Limited Warranty Policy is limited to the price of the product(s) or the cost of repair or replacement charges, whichever is lower.
